Mumbai, January 2025 – The Bombay High Court has advised Abhishek and Abhinandan Lodha, embroiled in a trademark dispute over the use of the ‘Lodha’ name, to explore mediation as a means of resolution. Justice Arif Doctor emphasized that the familial nature of the dispute could benefit from an amicable settlement rather than prolonged litigation.
The dispute dates back to a 2015 separation agreement wherein Abhinandan Lodha established “House of Abhinandan Lodha” while Abhishek Lodha retained control of the family’s real estate business under Macrotech Developers. As part of the 2017 settlement, Abhinandan agreed not to engage in real estate in specified regions. However, Macrotech alleges violations of this agreement, citing trademark infringement and consumer confusion, and has sought ₹5,000 crores in damages.
Key Updates:
- Macrotech Developers claims unauthorized use of the ‘Lodha’ name by Abhinandan Lodha’s companies, arguing it violates the settlement terms.
- Abhinandan Lodha’s companies maintain that their trademark, ‘House of Abhinandan Lodha,’ has been registered since 2020 and prominently used in all projects.
- The Court suggested appointing a mediator, potentially a former Chief Justice, to oversee the discussions, with both parties to confirm their willingness by the next hearing.
- Senior Advocate Darius Khambata, representing Macrotech, agreed to mediation on the condition of a time-bound resolution while highlighting the matter’s implications for shareholders of the listed company.
- Legal teams representing both parties presented their arguments, denying misuse and placing responsibility on external parties where necessary.
The High Court reiterated that resolving the family conflict could potentially settle the broader legal dispute, preserving goodwill and reducing legal entanglements.
Legal Representation:
Senior Advocates Darius Khambata and Veerendra Tulzapurkar, among others, appeared for the respective parties, supported by advocates from Veritas Legal, Kartikeya & Associates, Anand and Naik, Rashmikant and Partners, and others.
