About the Journal
The World Comparative Law Journal is a prestigious platform dedicated to publishing interdisciplinary research and scholarship on innovative and emerging legal concepts and practices across the globe. This special issue, titled “An Emerging ‘Human-Centred’ Paradigm for the Delivery of Justice: A Comparative Law Analysis,” is co-edited by renowned academics and researchers in the field: Dr. Anna Pivaty (Radboud University), Dr. Siddharth Peter de Souza (Warwick University/Justice Adda), Prof. Marijke ter Voert, and Prof. Pietro Ortolani. It aims to delve into the role of human-centered and people-centered approaches in justice sector reform, with a focus on the impact and application of digital innovations in judicial systems.
About the Special Issue
This special issue will provide a critical examination of the “human-centred” paradigm as it applies to justice sector reform and digital innovation. Often touted as an alternative to traditional, managerial approaches to public administration, this paradigm emphasizes the centrality of individuals in justice processes. The issue will explore the assumptions and practical implications of this approach, considering how it is employed in policy framing, the implementation of technical systems, and the development of legal technologies. Key questions include the extent to which “human-centred” designs truly focus on individual needs, and how these approaches are being adapted across various legal traditions and socio-political contexts.
A core aspect of the special issue is its decolonial perspective, examining whether human-centered approaches, often originating in Western contexts, contribute to a particular view of law and justice that may not align with the needs or perspectives of non-Western legal traditions. Contributions are encouraged to adopt diverse methodological approaches, from theoretical analysis to case studies and comparative law analyses, addressing digital justice innovations, policy implementation, and the socio-political consequences of these reforms.
