The RGNUL-SAM Conclave on Emerging Trends in Insolvency and Bankruptcy Laws is an upcoming event aimed at fostering scholarly discourse and practical insights into the evolving landscape of insolvency law in India. Scheduled for November 9-10, 2024, at the Rajiv Gandhi National University of Law (RGNUL), Punjab, this conclave invites law students, practitioners, and academics to submit research papers that explore various contemporary issues and innovations in this field.

Background of RGNUL

Established in 2006, RGNUL has quickly gained recognition as a premier institution for legal education and research in India. It is notable for being the first National Law University to receive an ‘A’ grade from the National Assessment and Accreditation Council (NAAC) and has been granted autonomous status by the University Grants Commission. Its commitment to legal scholarship makes it an ideal host for discussions on pressing legal issues such as insolvency and bankruptcy laws.

Purpose of the Conclave

The RGNUL-SAM Conclave aims to address the complexities and dynamism inherent in insolvency and bankruptcy laws. The legal framework governing these areas has undergone significant changes since the introduction of the Insolvency and Bankruptcy Code (IBC) in 2016, which streamlined processes that were previously fragmented across multiple legislations. The conclave seeks to provide a platform for emerging voices in law to contribute insights into how these laws can adapt to current economic challenges, technological advancements, and global trends.

Themes and Sub-themes

The overarching theme for this year’s conclave is “Emerging Trends in Insolvency and Bankruptcy Laws.” Participants are encouraged to explore various sub-themes, including:

  • Cross-border Insolvency and Global Implications: Analyzing how international practices influence domestic laws.
  • Green Finance’s Use of IBC: Investigating responsible debt restructuring through environmentally sustainable practices.
  • Harmonizing Legal Frameworks: Addressing real estate insolvency issues within India’s regulatory context.
  • Value Maximization Potential: Exploring avoidance applications in insolvency proceedings to enhance asset recovery.
  • Liability of Personal Guarantors: Examining the extent of personal liability under the IBC.
  • Reforming Corporate Insolvency Laws: Discussing treatment of contingent claims within insolvency processes.
  • Impact of Technology: Evaluating how blockchain and AI are reshaping insolvency proceedings.

Submission Guidelines

Submissions are invited from law students across India, with a word limit of 3000-6000 words excluding footnotes. Co-authorship is permitted up to two authors per submission. All papers must adhere to the OSCOLA citation style and should be original works that have not been published elsewhere.

Following this discussion, selected authors will present their research findings, fostering a collaborative environment for knowledge exchange among participants.

Conclusion

The RGNUL-SAM Conclave presents a significant opportunity for emerging legal scholars to engage with contemporary issues in insolvency law. By facilitating discussions on innovative solutions and best practices, the conclave aims to contribute meaningfully to the ongoing evolution of insolvency legislation in India. As stakeholders navigate the complexities introduced by economic fluctuations and technological advancements, platforms like this are essential for fostering informed dialogue and policy development within the legal community.
