About the Competition
The 5th VITSOL National Moot Court Competition on IP and Competition Law is scheduled to be held on 22nd August 2024 for the preliminary round (online) and on 8th September 2024 for the quarterfinal, semifinal, and final rounds (offline). The language of the competition will be English, and it is open to students pursuing a three or five-year LL.B Degree Course from any recognized College/University/Law School.
Each team must consist of a minimum of two members and a maximum of three members, with a maximum of two speakers and one researcher. Registration for the event is to be completed through an online form and payment of a non-refundable fee of Rs. 4,500/-.
The Moot Proposition
The Union of Arcadia, an island nation located in the midst of the Pacific Ocean, has a legal and policy landscape similar to that of India. The moot proposition revolves around the issuance of patents for software, the jurisdictional authority of the Competition Commission of Arcadia (CCA), and the liability of FusionLabs for contraventions under the Arcadian Competition Act.
In a significant legal battle, FusionLabs filed a Writ Petition under Article 226 of the Arcadian Constitution in the High Court of Erewhon to set aside an order passed by the CCA. The High Court of Erewhon consolidated both petitions due to their significance and urgency. The court framed the following issues for consideration:
- Does Arcadia’s legal framework permit the issuance of patents for software?
- Can the patent granted for Memetric be subjected to revocation, and if so, on what grounds?
- Does the CCA possess jurisdictional authority in respect of the subject matter?
- Whether FusionLabs is liable for the contravention of Sections 3 and 4 of the Arcadian Competition Act?
